One spouse files an Original Petition for Divorce in the county where either spouse has lived for at least 90 days. The petition sets out the grounds and the relief requested.
The other spouse is served with the petition and has 20 days to file a response. How they respond — or whether they respond at all — shapes the path forward.
In most cases with significant assets or children, temporary orders establish ground rules for the pendency of the case: who stays in the home, temporary support, and a temporary parenting schedule.
Both sides exchange financial information. Most cases resolve through negotiation or formal mediation without going to trial.
Once all issues are resolved — either by agreement or by the court — a Final Decree of Divorce is signed by the judge. In Texas, no divorce can be granted before the 60-day waiting period expires.
